Jesse James gets day in court, trial' ends with hung jury NORTHFIELD (AP) More than 120 years after a failed attempt to rob the First National Bank of Northfield, a mock trial failed to resolve whether Jesse James was involved. But Frank James was convicted of murder at Saturday's "trial," during which historians and others played the parts of the James and Younger brothers. Four people were killed in the raid on Sept. 7, 1876, including two gang members and a bank clerk. Dubbed the "Trial of the Century," the Northfield Historical Society's mock trial of the James brothers brought audience members back to the shoot 'em-up days in Northfield, which is about 40 miles south of Minneapolis.

Using no scripts, the historically costumed men and women relied on scraps of information to prepare for their performance. Wearing shackles and black-and-white striped suits, local men portraying the convicted Younger gang emerged from a horse-drawn sheriff's carriage to hear cries of "murderers" and "hang them." Audience members were costumed as well, the women decked out in bustled frocks and the men in waistcoats and gold chained pocket watches. The trial was a fund-raiser for the historical soci- ety, and audience members paid from $50 to $125 to attend. N. David Smith, president of the National James- Younger Historical Society, portrayed Jesse James.

Gregg Higginbotham, a professional actor, portrayed Frank James. Both men are from Missouri, as were the James brothers. "We were just suddenly thrust totally into the 19th century," said David Hvistendahl, a Northfield attorney who played the part of county a attorney George N. Baxter. "It was a lot of fun." A 12-member jury heard of testimony and arguments.

The James brothers each faced four charges stemming from the attempted robbery, including the murder of Nicholaus Gustafson of Northfield. Defense attorney Col. John F. Philips, played by attorney Ron Meshbesher, succeeded in casting reasonable doubt about Jesse James' whereabouts at the time of the heist. But because "the jury was hopelessly deadlocked on Jesse James," Hvistendahl said, the judge played by former federal Judge Miles Lord declared a mistrial.

"So technically," Hvistendahl said, "Jesse James can be tried again." Roy La Vigne, 79, Foley FOLEY Roy H. LaVigne, 79, died Saturday at St. Cloud Hospital. The funeral will be 10:30 a.m. Tuesday at St.

Minneapolis seeks flood assistance MINNEAPOLIS (AP) Mayor Sharon Sayles Belton and City Council members say they'll ask the Legislature for money to deal with damage from this month's unusually heavy rains. They heard Sunday from nearly 40 citizens who told tale after tale of flooded basem*nts, collapsed walls, floating cars and ruined houses. Republican mayoral candidate Barbara Carlson got loud applause when she told DFL Council Member Walt Dziedzic, "You want to blame everybody else the insurance companies, the Legislature. This is not a new problem. You have a sewer system that's 125 years old in Minneapolis." "I'm not blaming anybody," Dziedzic said.

He said the city would ask the Legislature for the same type of aid that cities in flood-ravaged western Minnesota will get. Information gathered from the hearing and additional surveys will be crafted into the city's request to the Legislature, Sayles Belton said. Lori Piotter, Caring Adm.
